2/10/03 Trial Update Print
Trials for the second group of defendants began today with Judge Mallon Faircloth proceeding. At the close of the court 24 defendants had been adjudicated. Eighteen of the defendants pleaded guilty and six pleaded not-guilty while stipulating to the facts offered by the prosecution. Eleven individuals received three month prison sentences, eleven received twelve months probation, one received six months prison, and another defendant received six months house arrest. In addition fines of up to $1000 and 250 hours community service were assessed. Eleven defendants have yet to be tried.

The trial began with Evalee (Lee) Mickey being sentenced to 90 days in prison despite being a first time crosser, pleading guilty, and her outstanding circumstances. In response defense lawyer Bill Quigley asked that he be held in contempt and be sentenced to 90 days in her stead. Bill stated to the judge, ?I fear for myself, and I fear for all of us if the law does not take into account our acceptance of responsibility and personal circumstances.? In addition Jane Lehr, Michael Ugarte, and Patrick Stanley each requested to serve Lee?s time for her. The judge denied each of these requests.
